Apple Gets Sued Again, Turns On Legal Team Auto-Responder

Fourth times a charm? At least that is what Jai Sen wants to believe as he recently filed the 4th lawsuit against Apple and AT&T in the New York Eastern District.

Similar to its predecessors (1,2,3), the lawsuit alleges that Apple and AT&T are “deceptive, improper, or unlawful conduct in design, marketing manufacturing, distribution and sale” of the iPhone 3G. If that doesn’t interest you, the complaint merely details some of what we have seen in the past. New additions include: hairline cracks in the iPhone case, 3G power demands affecting battery life, AT&T’s struggle to respond to the unusual demands on its infrastructure, and misleading advertising by both parties.

Naturally, in the end, the lawsuit is all about the bottom line. Jai Sen is seeking restitution (cash money), damages, and disclosures and/or disclaimers to be added to packaging and advertisements for the iPhone 3G.

According to iPhoneatlas, at press time neither Apple nor AT&T were available for comment…nor would they have made one if they were. At this point Apple’s legal team probably has their email accounts set to auto-respond.
