A San Diego based lawsuit was filed late last week that alleges Apple, and its carrier partner AT&T, have knowingly oversold the iPhone 3G, “promising fast speeds only to see a mass of customers bog down the network with devices that themselves are flawed.”
Apple and AT&T customer William Gillis filed an 18-page complaint that cites Internet reports (and rumors) as the foundation for the suite. With potentially millions affected by what Gillis claims as alleged flaws in the AT&T network and its interaction with the iPhone, Gillis is seeking class action status that would allow every AT&T customer in the state of California to pursue compensations if they’ve “suffered through sub-par 3G service.” Additionally, the complaint would have Apple and AT&T pay up punitive damages and restitution. The firms would be required to re-wire their marketing campaigns and PR tactics to halt any mis-information that may have triggered the filing of the suite in the first place.
William Gillis claims that due to the high volume of phones sold, and the fact that the iPhone requires so much power to operate, the signal demand for AT&T’s 3G network is far too high for it to handle, therefore it kicks users down to AT&T’s EDGE-based 2G network, even in areas where 3G coverage is guaranteed. Additionally, Gillis cites the acknowledgement by Mr. Steve Jobs himself to one iPhone 3G user, confirming a bug in the current software. Gillis’ problem lies in the fact that even though Apple plans to release software updates sometime this month, “no where on the packaging does it warn users that performance might not match up to customers’ expectations”.
So basically, the way we see it….Mr. Gillis has been reading far to many a online blog (hopefully MacBlogz). He has come across reports of unmet expectations from customers of two MAJOR corporations and figures he can pave the way for the millions of dissatisfied customers around the globe and take a stand against everything that is wrong in this world. Oh wait…This just in. After reading over more details of the lawsuit it appear William Gillis is just wanting money. Hahaha, go figure!
Apple nor AT&T have commented on the current lawsuit, which is the second lawsuit filed in as many weeks concerning the iPhone and the 3G network.
