Alabama Woman Files Suit Against Apple for False Advertising

An unhappy iPhone 3G user from Alabama, Jessica Alena Smith has filed a class action law suit against Apple over slow speeds and poor reception as well as profiting from a defective device. Is she serious?

Smith claims that she purchased the device shortly after seeing Apple’s advertisements promoting the device’s increased speeds. “One could barely turn on the television without hearing that the new iPhone 3G was ‘twice as fast for half the price,” the suit entails.

The suit also denotes that once in use, she had noticed that her internet connection, email and SMS were “slower than expected and advertised.”

Being an owner of the original iPod, Smith made claims that the new handset appeared to connect to a 3G network less than 25% of the time and would often drop her calls. She added that AT&T’s 3G coverage does extend well throughout the Birmingham area where she resides.

The real kicker here, is that she maintains that Apple is unfairly profiting from a defective device, and feels that she as well as other class members should be entitled to damages, costs and legal fees. With over 100 class members, the suit is seeking over $5 million in damages. Additionally, she is requesting that Apple repairs her defective device. If the woman had half a brain she would know that this problem is not aimed specifically at her. People the world over are experiencing similar issues lady.

I will have to point out that a “class action law suit” is called just that because the cause she is fighing against effects so many people.

That being said, since Apple has continued to achknowledge the iPhone set backs and disappointments, they might want to consider giving the super dissatisfied cutomer a refund?

my question is this: did she actually try to get her phone repaired or did she just call a lawyer. did she bother to update her software. did she call ATT and gripe about the extra data charge without adequate coverage and demand a credit on her account.

cause I would be really shocked if she went to an Apple store with a truly updated yet defective phone and they didn’t replace the phone. and where is her lawsuit against ATT for lack of coverage. they are the real demons it sounds like. not apple
